Surveys of the other three arterials--Concord Rd., Westford Rd., and Lowell St.-- have been completed, and the roadsides have been walked by members. Payment to Stamski & McNary for the surveys has been authorized.
Presentation of comprehensive analysis to the Board of Selectmen:
Jack, Deb, and John are preparing the financial analysis to include a surface analysis for each of the four surface options:
1) crushed stone and stone dust (of a smaller grade stone that on the Bedford Rd pathway),
2) crushed stone and stone dust with a polymer surface,
3) organic stabilizer, and
4) asphalt.
Deb has most of the financial numbers and will have the rest soon.
We will request to be on the agenda at the next Land Use Committee meeting.Update of other matters:
- Bedford Rd. pathway repair at 209 Bedford Rd. will require an easement from the Zezimas. Nancy will contact the Zezimas to request the easement.
- Recording of Easements- We have a draft “as- built” survey for Bedford Rd. Once complete these surveys will be used to formally record the easements that have been granted. In some cases a subordination of the mortgage may be required if an underlying mortgage exists. Nancy will look into the Town of Acton's process of recording easements to get an idea how our notice to grantors should be worded. She might also contact Alex Parra. We need to have these completed for Town meeting vote in the spring.
- We might need an additional easement at Lewis and/or Kidder properties on Bedford Rd.
- The as-built survey will need to reflect an additional portion of the easement property on the other side of the ATM driveway but still on Senkler property.
- East Street pathway plan wetlands flagging for Conservation notice, has been arranged by Deb. A professional will do it within our budget and will also mark the wetlands on the map. Deb will prepare a letter to abutters requesting that the flagger have access to their properties. He can do it in the winter snow.
- For the Bruce Freeman rail trail, Deb will ask Tim Eliassen to represent our committee in completing a CPA application for funding the Carlisle portion of the design costs. He would work with the Trails Committee who has recent experience. The pathways committee will sponsor the application for about $3- 5,000.
Membership: The Committee unanimously voted to recommend to the Board of Selectmen that Deb Belanger join the committee.

Pathway maintenance
Nancy reported on the September 29 maintenance meeting held with the BOS. The objection of the BOH to any herbicide use and the lack of proposed alternatives precludes further meetings of any maintenance task force. The Committee is concerned about the best way to remove poison ivy from the sides of the pathway, but we will not pursue the issue until the spring.
The consideration of alternative pathway surfaces is now our plan to ameliorate pathway maintenance (excluding poison ivy on the sides). The Committee decided not to pursue extensive testing of different surfaces, however, in an effort to save time and money. Rather, we will research the effectiveness of different surfaces already in use in New England (our climatic region) and obtain photos if possible. In addition to the current 1/4" crushed stone/stone dust aggregate, the alternative surfaces include the crushed stone/stone dust aggregate combined with a binding polymer, organic stabilizer, asphalt, and a type of concrete surface that can have a stone appearance impressed on the surface, as suggested by Bob Koning. Frank said that a university study has should the polymer to be suitable in pathways, as long as the pathway is not used by horses. In addition to investigating the effectiveness, the costs per linear feet will also be researched, as planned. Frank, John, and Deb will do this research. The cost and maintenance alternatives will then be presented to the Board of Selectmen and then put before the Carlisle Land Use team.
Bedford Rd. pathway repair
- Rather than immediately resurfacing from the library to the post office, especially in light of surface material selection question, the Committee decided that the priority should be repairing the pathway in front of the tree at 209 Bedford Road next to the Zezimas. The pathway is crumbling into the road, because there is not enough room between the road and the tree. We, therefore, would like to get an easement from the Zezimas to build the pathway behind the tree and onto their property. Frank will pursue this.
- We will consider applying polymer to this newly built section, if the initial costs for a small section are not too great.
- We will also draw up a sectional detail of the pathway built here.
East St. pathway
- ConsCom notice of intent: Heather and Deb will pursue flagging and marking the wetlands. A motion to contract a wetlands specialist for up to $1200 to assist in the flagging was approved. For the estimate of the eventual cost of wetlands remediation, Frank will talk with Sylvia Willard.
- Retaining wall design: A motion to approve the payment of the Ross bill for $1450 was approved. For the rolled-in boulder plan, John will ask Deb to try to obtain from Carl Hanscom a guess on how much it would cost, not a formal estimate for his job, so that we can plan our budget. John spoke with Gary Davis about the possibility of Carl Hanscom building the wall, and Gary was OK with that.
Surveys of other arterials
We received the survey from Stamksy & McNary for Lowell Street, and we expect the other two within a few days. John will make copies and do the eventual marking of the plans. We will ask Eileen to coordinate the walk of Lowell St.
Bedford Rd. as-built survey
Art presented the as-built survey from LandTech, but modifications are still needed: the continuation of the pathway past the ATM to the start of the School St. property, indications of the right of way (old road) along 67 and 71 Bedford Rd. just before the Seawrights, and then the planned easement and detour of the pathway behind the tree and the Zezimas. Art will pas this job on to Nancy, as he will be away for the winter.

Nancy gave a presentation on the pathway surface and maintenance concerns. She also reported her research on the health safety of glyphosate, in which she found the direct health detriment to be very limited or unsubstantiated. Nancy reported that glyphosate is less damaging to the environment, which can be through the surface water, when "painted" directly on plant leaves.
Nancy also reported having spoken with Mike McLean, the right of-way management state official who said that, glyphosate, as "Roundup", can be used once a year with up to 10% additional application, but the acetic acid preparation "Burn-Out" cannot legally be used. To use any chemical does require approval, according to the right-of-way management laws, due to the location of public water supply and private wells.
Martha Bedrosian said the use of Roundup to eradicate weeds in pathways is unacceptable. One-time painting on Roundup on remaining poison ivy that cannot be mechanically eliminated could be considered by a vote of Town meeting, although the BOH would vote against it under any circumstances.
Tim Hult said that the economics of alternate surfaces needs to be considered. The committee will test crushed stone with a smaller size stone and also with the combination of a polymer on sections of Bedford Road before making a recommendation for the rest of the pathways.

- Sylvia Sillers of Concord Rd. expressed concerns over the surface of the planned pathway, because the current surface off the road in some areas along Concord Street is nicer than the Bedford Rd. pathway.
Presentation of Comprehensive Cost-Analysis to the Board of Selectmen
This will be to consideranalyze total project costs as well as different surfaces, and will be done at a future yet-to-be-determined date. Preparation will include:

Bedford Rd. Pathway ADA Compliance and Maintenance
ADA compliance: Frank presented feedback from Building Inspector Bob Koning:
- curb cuts are OK and in compliance
- grade changes are OK and there is no need for compliance except at curb cuts
- surface condition is not so good in the section from the post office to the center, as the stones are too large and the surface is unstable. So we should focus on resurfacing this section. One-quarter-inch stones would be fine
Mechanical maintenance of Bedford Rd (John and Frank)
John and Frank will work with Kevin Stacy and Gary Davis to resurface the pathway from the Post Office to the center with 1/4" stone and stone dust, with a test of added polymer mix in front of the library section, using money from the BOS approved maintenance budget, but keeping some money in the budge in serve for possible testing of organic stabilizer elsewhere later.
Right of Way Maintenance Plan Task Force
Nancy presented the state regulations, which are quite bureaucratic. Nancy will meet with Tim Hult, our BOS liaison to discuss moving forward with the task force including members of ConsCom, BOH, CPAG, BOS, and our committee.
East Street Pathway Planning
Retaining Wall design - Frank will check with John on the design. John will check with DPW. Frank will get quotes from Carl Hansom and Kevin Stacy.
- St. Irene's easement - Heather is trying to get the deed information for the easement document and will get it to Eileen
- Other East Street easements - we need to fine out of the ConsCom Notice of Intent should be done before an easement on the affected property.

Nonmember: Deb BelangerMadonna has informed us that the pathway must be ADA compliant. Determining whether the pathway is ADA compliant will be up to the building inspector Bob Koning. Loosening large gravel in the pathway may jeopardize its ADA compliance. The Bedford Rd. pathway surface may contain stones that are too large also contributing to weed growth.
We have received memos from the Board of Health and from ConsCom informing the Committee of the regulations pertaining to the use of herbicides on rights of way. In light of this information, we will not be testing herbicides for now, contrary to discussions with the Board of Selectmen.
The Committee agreed that the development of a right-of-way maintenance plan would be best coordinated by a joint task force. Nancy will chair or co- chair the task force to include the Board of Health, Cons Com, CPAG, and a representative of the Board of Selectmen.Deb presented a cost estimate of different pathway surface types.
John reported that the string trimmer was not effective of removing weeds growing up in the middle of the pathway, but it was effective at cutting back poison ivy along the sides.
The Committee agreed that it would be best to develop information across a range of planning areas with the goal of presenting a comprehensive analysis to the Board of Selectmen in the Fall. Tasks for Bedford Rd. pathway weed eradication, pathway maintenance in general, East Street pathway construction, and future road surveys were outlined and assigned:
- Talk with Bob Koning about pathway ADA compliance - Frank and Deb

Pathway maintenance plan
The growth of weeds has made the pathway no longer ADA compliant.
We had originally budgeted $4000 - $5000/year for pathway maintenance.We need to consider
- What to do with the current weeds and surface on Bedford Rd.
-- We will use crushed stone of a smaller diameter so that it compacts better.- What to do with future paths? We will use smaller stones so it will compact better.
What to do with the current weeds and surface on Bedford Rd. Deb presented alternatives:
- Spray chemical herbicide (roundup): costs $500 for all of Bedford Rd. path but has political opponents
- Add additional surface: costs $700o - $10,000 for all of Bedford Rd. path
- Use the bobcat bucket to scrap and compact the surface: costs $1000-$2000 for all of Bedford Rd. path
- A combination of adding some new materials (not for the entire length of the pathway) and compacting in certain areas: costs $5000 for the Bedford Rd. path. Deb recommended this option.
Nancy presented her research of the chemical herbicide Roundup (glyphosate) compared with organic (acetic acid) alternatives. Glyphosate is "relatively safe" compared with other more complex herbicides. John pointed out that Roundup is approved by the EPA and state agencies for killing weeds. Acetic acid is approved as an herbicide in concentrations only at 6%, as the brand Burnout, but is less affective. In concentrations of 20% it is not approved as an herbicide.
John suggested using string trimmers (weed-wackers) directly on the path along with plywood panels in a team effort to cut the weeds at the base (and keep the gravel on the path) as short-term weed suppression. They could also experiment with sweeping, raking, hoeing, removing and adding material, and compacting to improve the path surface. With that direct experience they could then direct a professional crew in a cost effective manner.
- A motion to spend up to $5000 for mechanical maintenance of Bedford Rd. (weed trimmers, raking, compacting, additional materials) passed unanimously.
- A motion to recommend testing both Roundup and Burnout away from wetland buffers and with abutter approval passed unanimously.
East Street retaining wall
We need a structural engineer to work with Gary Davis to create the retaining wall with an as-built design afterwards.
- A motion to build a natural conforming set boulder retaining wall for East Street, and, in lieu of a before-built design, to have an onsite professional engineering supervision passed unanimously.

These boulders would become unavailable by July 8, so to have them for building the retaining wall, we needed to request their removal and storage at this emergency meeting today.
A motion to build a retaining wall on East Street for the pathway passed unanimously.
A motion to pay up to $500 for the hauling of the boulders (expected to be three truckloads) from the construction site to the property of David Flannery (as there is no room currently at the DPW) for DPW use in building the retaining wall passed unanimously.

East Street pathway plan

- The ConsCom hearing made positive determination, requiring us to file a notice of intent, which requires 1) flagged wetlands by an expert, 2) flagged wetlands marked on the map, and 3) engineer-designed pathway construction details for where the pathway lies next to wetlands. Jack will look for someone to flat the wetlands.
Planning for the June 20 public hearing on pathway maintenance was discussed.

Bedford Road pathway

East Street pathway plan approval process
- The May 9 Planning Board hearing approved the pathway, with the removal of marked trees and stone walls sections, excepting the retaining wall section (to be determined) and the lower four maple trees by the drainage basin at St. Irene's (to be determined if necessary to remove). This will be taken up again at a follow-up meeting by the Planning Board on June 13. Art will attend this meeting.
- The hearing with the Conservation Commission will take place on May 26. Jack will attend.
- The hearing with the Historical Commission is planned for June 21, but we will try to move this up to June 14. The application needs to be submitted by Tuesday, May 26. Heather will do this and will attend the meeting.
- We would like to be on the agenda of the Board of Selectmen on June 28 for final approval of the East Street plan. Jack will attend this meeting.
East Street easements
- We need a list of the easements that will be required. We won't do the paperwork, though, until the exact pathway is finalized.
Bedford Road pathway
- A cost analysis of Bedford Road needs to be done.
- The Bedford Road final survey and recorded easements is still needed form LandTech. We want to get them approved at the fall Town meeting.
East Street planning
- Frank and Deb will meet with St. Irene's church representatives to try to get the pathway to go up the hill, and no retaining wall is needed.
- Meanwhile, we will pursue the retaining wall design. boulders instead of interlocking artificial bricks will more likely get committee approvals (Planning Board, Historical Commission, Board of Selectmen)
- Sean and John need to conclude the costing estimates for the retaining wall system vs. boulders.
Pathway maintenance
- We should have a public hearing to let all committees provide input on the issues. It will be at our June 20 meeting.
- The weed torch did not prove well.

- A public hearing has been scheduled with the Planning Board and the Tree Warden on May 9 at 7:45 for the approval to remove trees and stone wall sections in accordance with the Scenic Road bylaws and the Shade Tree Act. A notice has been placed in the Mosquito and abutters are being mailed. We still have to post notices on the trees affected, but this can be done up to one week before the meeting.
- Sean will conduct a walk of East Street with members of the Planning Board on May 2.
- The retaining wall engineering design proposal submitted by Ross and Associates and approved by our committee in our last meeting has not yet been accepted by the Town Administrator, Madonna McKenzie, because she thinks that it might have to be considered a separate project requiring multiple bids, rather than being an extension of Ross's original survey work.
Survey quotes for additional roads
We have received the minimum three bids for the combined surveys of Concord Rd., Westford St., and Lowell St.: Stamsky & McNary for a total of $35,750 (to take 6 weeks) and from Ross & Associates for a total of $36,075 (to take 8 weeks), and H-Star Engineering for a total of $45, 475. LandTech was asked, but chose not to bid.
- A motion to accept the bid of Stamsky & McNary for surveying Westford St. for $12,600 (as the low bid compared to Ross for $12,675 and H-Star for $20,500) passed unanimously.
- A motion to accept the bid of Stamsky & McNary for surveying Concord. Rd. for $13,300 (as the low bid compared to Ross for 13,650 and H-Star for $18,000) passed unanimously.
- A motion to accept the bid of Stamsky & McNary for surveying Lowell St. for $9,850 (as the low bid compared to Ross for $9,750 and H-Star for $15,000) passed unanimously.
Bedford Rd.
- Work on redoing the brick walkway and landscaping in from the the ATM/Senkler property is underway, so we will soon be able to get the entire Bedford Road as-built survey done soon. Art will contact LandTech, the originally surveyor, which had quoted $2940 for the as-built survey.
- The path needs to be marked on the other side of the ATM driveway.

Eileen received two quotes for surveys of the other three roads (Concord St., Westford St., and Lowell St.), which were from Stamsky & McNary for a total of $35,750 and from Ross for a total of $36,075. We need a minimum of three bids, so we will defer the vote. We expect to receive two more bids.
Eileen presented an overview of our finances. We have $9799.63 in our account, left from the original proceeds of $10,000 deposited from a developer. All of our Chapter 90 funds of $30,000 have been spent. Of the $150,000 town budget, we have a balance of $137, 2000 remaining.
The East Street pathway redline map has not yet been received from Ross. Once received Sean will use it for a walk-through with representatives of the Planning Board and ConsCom on a Monday morning. It will then be presented to those Boards for approval.
Based on David Kolstad's preference not to be an active member and his inability to attend meetings, a motion to accept his resignation passed unanimously.

- We will request from Eileen a total accounting for pathway survey, construction, and materials and DPW hours
- The as-built survey of Bedford Rd is still pending possible pathway modifications on George Senkler's commercial property with the ATM. George has now said that perhaps nothing more needs to be done. We will walk the site and make recommendations.
Pathway maintenance
- Deb Belanger has requested maintenance cost breakdowns.
- The Board of Selectmen have approved our request to buy the weed torch. John Bakewell will follow up with Madonna about how actually to purchase it.
Other three arterial roads
- A draft RFP has been prepared. Corrections were made. It will be sent to Stamsky & McNary, Ross Associates, and LandTech, for a combined and breakdown costs survey of Westford Road, Lowell Street, and Concord Street. Eileen and Jack will take care of preparing and sending it out.
East Street pathway construction
- Sean (who could not attend the meeting) submitted an updated on the estimate for East Street, which he obtained from Kevin Stacey, including $18,000 for a Versa-Lok retaining wall system.
- We still need to finalize the pathway design plan
- Obtain a design for the retaining wall from Gary Davis and/or Ross Associates
- Have Ross prepare the revised pathway design plan, for which they have already provided a quote, based on information from abutters provided by Sean and retaining wall design
- Discuss issues and obtain approval for the plan from the Planning Board, ConsCom, and Historic Commission
- Put the plan out for construction bids (we essentially have one from Kevin Stacy already)
- Vote on bidder and submit our decision to the Board of Selectmen for approval
- We are in agreement to keep the pathway on the north side of East Street and build a retaining wall. If funds are insufficient, the construction will be divided into two phases with the second phase, starting at the first driveway of St. Irene's, to be completed later. The second phase is also pending technical issues of the possibility of St. Irene's moving its stone wall and the DPW redoing the brook culvert.

- Easements were secured and the pathways was completed to the ATM in December.
- Frank spoke with Gary about taking out the curbing at the library and the post office driveways. Gary said he would get to it, but it's not a priority at the moment
- LandTech will do the as-built survey of Bedford Rd, but since George Senkler still has not done his own landscaping and pathway construction in front of the ATM, the pathway is not considered all the the way complete. Art will get the easements from Madonna to give to LandTech so that they can at least work on most of the survey, and Art will let George Senkler know that we would like his pathway section completed, ideally by the Spring Town meeting for vote of acceptance.
- All outstanding invoices for Kevin Stacey and LandTech for Bedford Rd have been paid.
- Sylvia Willard of ConsCom requested a map of the pathway plan. Art will get it to her.
Pathway maintenance
- Snow plowing is being done to the post office. Frank will check with Gary to confirm the distance and also ask the depth of snow for plowing, so that we will have that information if people ask.
- For week control, pesticides have some opposition within the Town, so John recommended use of a propane torch to burn away the weeds. Weed control is more of an issue only in the first year or two, before the surface is fully compacted. A motion to recommend to the Board of Selectmen spending up to $500 from pathway funds to purchase for the town a propane week torch with cart passed unanimously. John will research the specifications and give it to Heather to submit to Madonna.
East Street pathway
- Sean (who could not attend the meeting) submitted an update on the estimate for East Street, which he obtained from Kevin Stacey: tree removal at $3000, fieldstone wall for the pathway in front of 129 East St., Barbara (Maxwell) Waites at $810, and alternative cobblestone pathway edging in front of 129 East St. at $378. He needed the linear feed for the pathway construction, which Eileen has at 2200 feet, which she will give to him.
- Heather will meet with each Art and Mary-Lynne to learn how to research easements.
- Eileen and Frank will begin looking into how to get the St. Irene's easement.
Other three arterial roads
- In pursuing surveys of the remaining three arterial roads (Concord St., Westford St., and Lowell Rd.), John will e-mail the multiphase survey used for the East Street survey to Eileen, who will modify it, get it to Jack for approval and then submit it to contractors and hopefully get it back by our next meeting.
